Ashy Bines: body transformation specialist or scam artist?

Ashy Bines is a rising star in Australia’s diet and fitness world. However, with fame comes publicity, and it’s not always positive.

For $69 plus GST you can purchase a 29 page E-book containing guidelines and tips which you probably already knew, for achieving the body you always wanted. This also allows you to join a member’s only forum, in which you can chat with other women all wanting the same thing: a body like Ashy’s.

Many however have complained that the forum doesn’t provide the support they’ve paid for, with Ashy often telling people to Google things they want to know.

“This plan or ‘guidelines’ may be misleading due to the lack of service Ashy is offering and the ridiculous price she is charging for her so called plan.” said a product reviewer.

With over 280,000 likes on Facebook, one would assume Ashy’s plan is some sort of diet and fitness miracle. Yet, with another quick search, you’ll find another Facebook group claiming Ashy’s diet plan is a waste of money. This group has over 11,000 likes.

The problem the administrators of this Facebook group have with Ashy’s diet plan is that it is breaching Australian Consumer Law legislation.

Anne, an administrator of the ‘Ashy Bines Bikini Body Challenge = Waste of $’ Facebook page, says that Ashy and her product are misleading and deceptive.

“1. You cannot guarantee weight-loss [and] 2. You cannot offer 24/7 supervised forums and not provide them.” she says.

The Australian Competition and Consumer Commission have yet to take action despite complaints from those in this group.

Ashy Bines does however have many loyal followers who swear by her plan. Tara Morgan is one of them. Of her results, she says that they were “Better than imagined, I dropped 7% body fat and put on 5kgs of muscle…”

ASHY BINES DIRECTOR OF ABBBC PTY LTD SENDS EMAIL ADVISING HER CLIENT / FAN BASE THAT SHE WANTED TO WHIP UP A QUICK GUIDE – Well sadly, she did not whip it up, instead of writing to her fans and acknowledging the source and saying for example ” I found this great article for you all which I hope will provide you insight and assistance” and then putting in a link to acknowledge the source, she simply adopts it as her own. By her own conduct she is damaging her reputation on her own accord. The brand Ashy Bines or ABBBC cannot have credibility or integrity if it is in effect ‘stealing’ other people’s work and passing it off as their own.

Respect is earned, you cannot command respect if you are pretending to be someone or something you are not, transparency leads to corporate integrity. This has been endemic conduct by Director Ashy Bines, it is not the first time we have exposed her plagiarism, nor plagiarism by Director Steven Evans. One mistake,  perhaps an individual could accept that they failed to cite their source, but after being exposed now for multiple offences of duplicity and plagiarism, it would appear on its face that the lesson has not been learned.

Further it undermines the credibility of the corporate structure, its directors and reinforces to potential customers that at the end of the day, why do they need to pay for the product sold by ABBBC Pty Ltd, when all the information is free on the internet, and there are a number of free groups for Clean Eaters such as https://www.facebook.com/groups/cleaneaters.com.au/?fref=ts    SENSIBLE CLEAN EATERS FREE FACEBOOK GROUP .

I’m also happy to stay after each Tuesday and Thursday evenings to answer any questions!

Getting off track is easy! You’ve been clean for a few weeks and aren’t losing weight like you thought you would.

It may be because you’re consuming more calories than you think.

Keep reading to discover seven sneaky habits that may be sabotaging your weight loss efforts.

Mistake #1: Forgetting Liquid Calories

It’s easy to forget that the things you drink have calories – some more than you’d think. In fact, some beverages have more calories than an entire plate of food.

It is estimated that around 20 precent of your daily calories come from what you drink. So as you drink your juice with breakfast, rehydrate with a sports drink at the gym, or drink a glass of wine at dinner, think about the calories you’re adding.

For calories’ sake, it’s best to avoid all sweetened sodas, sweetened or flavoured coffee drinks, sweetened tea, and smoothies. Replace these high-calorie drinks with water, skim milk, and unsweetened herbal tea. Because while they taste great, liquids generally don’t satisfy hunger, so they are just empty calories.

Mistake #2 Meal Skipping

Many dieters think they’ll cut their calorie intake by skipping a meal, usually breakfast.

But this is a mistake.

Research has shown that those who skip breakfast actually weigh more than those who eat three meals a day. Skipping a meal usually causes you to eat more calories during the day because you will end up eating even more food later in the day because you’re so hungry.

So aim to eat three meals MINIMUM and aim to get 6 in- smaller regular meals increase your metabolism burning more calories at rest! A healthy breakfast that will keep you feeling full all morning contains protein and fiber. An example would be whole-grain toast and an egg.

Mistake #3: Oversized Portions

Just because restaurants load your plate with a mountain of food doesn’t mean you should eat that much at home for a normal meal.

Remember that your stomach, like your heart, is the size of your fist. Don’t think you could fit much food into your fist? You’re right. And contrary to what mama taught you as a child, you don’t have to eat all the food in front of you.

To eat a little less, use smaller plates and eat slower so you know when you’re full- if your like me and pummel down food you have to get the amount right instead of going off ‘feeling’ full because if you eat until you get this feeling you’ll be so far gone by the time the 20 minutes has caught up to you – you’ve completely over eaten and can’t move from the couch. Also, remember that portion control also applies to healthy foods, as they, too, contain calories.

Mistake #4: Too Many Extras

A salad is a healthy, low calorie option. At least until you add dressing, bacon, cheese, and croutons.

These add extra calories fast.

One tablespoon of dressing contains 75 to 100 calories. With that in mind, it’s no wonder grilled-chicken salads at a fast-food restaurant can have more calories than a hamburger.

Mistake #5: Slacking on your protein

If your looking to tone up and lose weight protein is super essential! You need a hit straight after training but also another 2-3 serves a day -cottage cheese at morning tea, can of tuna at lunch and half chicken breast are some examples!  WHY?- proteins are the building blocks of our bodies. They are what your muscles are made of and if you’re doing intense training and not supplying your body with the correct foods to generate muscle production you will not get toned and lean!- remember the photo of the ‘diet’ ‘exercise and diet’ bum I posted on facebook? That’s what will happen! When you’ve generated some more muscle your body burns more calories just existing as well! WINNING!

Mistake #6: Eating Without Thinking

It happens to everyone. You’re tired after a long day and you just want to veg in front of the television or read a good book. Unfortunately, mindlessly eating is often involved. You may think that since it’s not on a plate it doesn’t matter, but every bite you take counts.

When it comes to a successful diet, make rules for appropriate times to eat. And don’t always feel the need to eat when relaxing. Try sipping on water or tea, chewing gum, or simply don’t put anything in your mouth.

Mistake #7: Eliminating All Treats

Dieters often become overzealous in their plan and completely rid the house of all the food they enjoy, whether chips, sweets, snacks, or any high calorie food.

This commitment may last a few days until you can’t tolerate it any longer and you overindulge on what you deprived yourself of.

A better plan is to allow yourself a treat every once in a while. TREAT not binge!

Remember that everyone makes mistakes, but be smart and don’t let these common pitfalls keep your from meeting your weight loss goal!

It’s easy to only focus on the foods that you’re not supposed to eat when on a diet, but by changing your focus to all the foods that you are able to freely eat you’ll stay motivated and stick with it.

Pack as many non-starchy vegetables as you’d like into your daily diet as well as fresh, seasonal fruits. Experiment with different methods of preparation for exciting variety.

Weight Loss Supplements – What are you really buying?

Weight loss is often a slow and difficult process in which most of us find frustrating and it can become quite difficult to maintain motivation.  Many of us might seek assistance in speeding up this process and in gaining support to achieve the results we want!

Thus the weight loss industry is born!

Many companies have ventured into this ever expanding industry trying to get a juicy piece of the pie.  You only have to walk into your local supermarket, health food store or chemist to see a wide variety of weight loss products ranging from shakes, sweets, meals and tablets and in such an industry the price tag can SKY ROCKET!

The issues arise not only to the quantity and effectiveness of the product, but perhaps more importantly the safety of the product to the individual. One such product that has been in the media of late is USPlabs’ OxyELITE Pro. The online website describes the product as “…a pharmacist formulated “Super Thermogenic™” so laser targeted, its potency is unmatched.”  As it turns out “potency” may be a more appropriate description than originally intended.

OxyELITE Pro was branded the “super thermogenic fat burner” and intended as a pre workout dietary supplement that assisted in increasing metabolic rate, decreasing appetite while enhancing the consumers’ mood. The product claimed to help you lose weight even whilst you are sleeping.

Various promoters of the supplement claimed it to be a “safer alternative to ephedrine” which was a commonly used stimulant and appetite suppressant that the U.S. FDA (Food and Drug Authority) declared adulterated in February 2004 as presenting unreasonable risk of illness.

One of OxyELITE Pro’s main ingredients is 1,3-Dimethylamylamine (DMAA) and in which lies the source of the predicament for the company. 

Initially, The FDA had noted the possible side effects and life-threatening complications of the food additive, however as termed “food additive” the ingredient did not require FDA approval. Nevertheless, various organisations had forbidden the stimulant such as the Major League Baseball.

Further investigation into the product presented numerous medical cases with some of the most serious side effects reported including heart issues (e.g. Irregular heartbeat, stroke, heart attack, and elevated blood pressure) with side effects to other areas of the body such as liver and kidney damage/failure). In early 2012, US Department of Defence banned any dietary supplement containing DMAA in military facilities following the death of 2 soldiers.

In May 2012, the FDA administered warning letters to DMAA supplement manufacturers and in April actioned four lawsuits against particular products. The FDA claimed that prior to promoting products containing this ingredient; manufacturers had the responsibility by law to inform consumers of the safety of their product with evidence, in which FDA report had not been conducted.

In June, Food Standards Australia New Zealand (FSANZ) warned not to consume any dietary supplements containing the ingredient DMAA, until The Australian Federal Department of Health and Ageing and the Advisory Committee on Medicines Scheduling could discuss a potential ban on the ingredient. The New South Wales Food Authority tested 12 pre-workout products of which 11 had tested positive for DMAA.

On the 1st August 2012 The Therapeutic Goods Administration (TGA) has posted its final decision on DMAA and was included in Appendix C of the Poisons Standard, therefore the sale, supply and use of DMAA would be prohibited. FSANZ advised any individual who has consumed this ingredient and is concerned about potential health risks to seek medical assistance.

Brands tested positive for DMAA included: Noxpump; 3-D explosion; Beta-Cret; PreSurge; 1 MR; Cyroshock; Jack3D (promoted as a “nitric oxide per workout supplement”); Mesomorph; Neurocore; Oxyelite powder; Hemo Rage Black.

The product label lists “1,3-Dimethylamylamine (Geranium [stem])”  presenting the ingredient have had been derived naturally from the geranium plant. The evidence to this appeared very weak, and it was believed that it was synthetically produced DMAA and therefore not eligible to be used as an active ingredient in dietary supplement.

In addition, this topic leads to the discussion of products deemed as “natural” and that this does not necessarily mean the product is safe or safe for everyone.

DMAA can be listed as any of the following;

• Geranamine, Geranium oil, extract, or any part of the geranium plant
• 1,3-Dimethylamylamine
• 1,3-dimethylpentylamine
• methylhexaneamine (MHA)
• methylhexanamine
• methylhexamine
• 4-methyl-2-hexanamine
• 2-amino-4-methylhexane

Geranamine is a natural CNS stimulant that was first synthesized in 1944 and was used as a main ingredient in fitness supplements and weight-loss products. This ingredient is still legal in most countries as the compound is a natural component of geraniums (plant) and therefore it can be sold as a dietary supplement under current FDA laws.  In 2010, the World Anti-Doping Agency (WADA) added geranamine to the list of banned performance enhancing substances.

In addition, WADA banned DMAA along with the Canadian and New Zealand government, following cases of related deaths and other side effects reported by users of products listing this ingredient.

There are continuing law suits in the U.S. over the OxyELITE Pro and other products containing the ingredient DMAA.

OxyELITE Pro is currently banned in Australia, however it can still be purchased online and this raises the discussion of litigation on the transportation of supplements between nations. 

The take home message of all this, is to be wary of the products you are taking or considering taking and understand that some dangerous products are still being sold online and illegally by some people in Australia. Ultimately, we all need to move away from the overuse or un-necessary use of these supplements and many other products like this which ‘spruke’ performance enhancing benefits or fast tracked weight loss or fat burning. While we are all guilty of wanting results NOW keep in mind that the usual aim of losing weight/fat and getting fit and strong is to be HEALTHY. The supplement industry is giving the fitness industry a bad name and in many people’s eyes it is more an industry of BEAUTY rather than health which is unfair to the genuine trainers out there. If you are taking any supplements understand there is poor regulation and products that are unsafe are likely still on the shelves! Always seek independent advice from a medical professional and ensure that the product is deemed safe by Australian standards before consuming. Your life is not worth it. Measure your success in a different way and get back to focusing on health over beauty.

What ABBBC= Waste of Money Stands For – Sick of being attacked for Having a Social Conscience

It takes a lot of courage for people to take an activist stand and  fight for the rights of consumers and or to engage in consumer advocacy https://www.facebook.com/ashybinesbikinibodychallengeisawasteofmoneyis a consumer community which provides evidence and information on how clients can obtain refunds, how they can find alternative health solutions and we also focus on the unethical conduct of ABBBC (Ashy Bines Bikini Body Challenge) having regard to the high volume of customers who are unhappy with the product Ashy Bines is selling and / or the service received by her.

The primary issues:

1.       The Ashy Bines Clean Eating Diet Plan is not a diet plan, it is only guidelines but it is still advertised as a diet plan which misleads clients into believing they are receiving a structured meal advice program. They are not receiving such a diet plan, they are only receiving guidelines. A 28 page pdf!

2.       The Ashy Bines Clean Eating Forum is unmoderated by professionals which has led to individuals selling banned substances that are categorised as offences both under the Federal Crimes Act and the Customs Act and which contain dangerous ingredients banned in this country at this time. (see previous blogs).

3.       The Ashy Bines customer service offers 24/7 access to forum with professionals yet individuals have to wait 24/48 hours for a response some wait longer  and in some circumstances the advice is negligent, demonstrated as an example on one of our blogs relating to the advice given to a pregnant woman which was reviewed by Diet Chat Accredited Dietitians which demonstrates the advice given by Ashy Bines was negligent.
      
       The service sold  by ABBBC of 24/7 moderated forums is a furphy. 

4.       Ashy Bines claims that she is Australia’s Leading Transformation Specialist and has awarded herself an award entitled   Best Female Health and Fitness Program in Australia  yet there is no such award which has been provided to her nor does this award exist.

5.       Ashy Bines claims she received qualifications from the UK, https://www.facebook.com/photo.php?fbid=270215356432074&set=a.227369644049979.50932.227075700746040&type=1&theaterfact, she never attended this course, it has to be attended in person by attending the college in the UK and we verified this fact by email and telephone contact. Thus this is also unethical misleading but lacking integrity from a corporate director of ABBBC Pty Ltd.

7.      The “no refund policy” which has been altered three times in the last three months is a breach of consumer laws. You cannot say that a person is never entitled to a refund.

1   We have nothing personal against Ashy Bines the person. We do not know her and we are not interested in her personal life. We are intelligent enough as a community to not only separate the person from the corporate brand but to then seek answers and demand accountability for some transformations which we have proven to be non-members of Ashy Bines Clean Eating coupled with  a complete failure to provide the service / product delivery promised to her customers.      Further by offering a blanket guarantee that a person can lose weight fast ‘guaranteed’ we say this is also a breach of ACL legislation, not only does it not qualify as ‘puff’ it falls into the category of conduct which tends to induce women to believe that her diet will guarantee results.

Now, people have to take some responsibility and do some research that is why there is a GOOGLE function, but when you are talking about the vulnerabilities of women who are desperate to lose weight and who see, on a daily basis,  photo shopped photos and some fantastic inspirational stories, the emotionality takes over and common sense seems to dissipate thus why when there are 35,000 members in the Ashy Bines Clean Eating Group and 11,000 unhappy customers (  not counting those who have passed through our service and moved on once we have assisted them with resolution processes).

Now you have to ask the question what is ABBBC doing wrong? Why are they not listening and are they just promoting an unsustainable lifestyle which has resulted in a backlash of thousands of unhappy customers, when they receive the product and question “what is this” “I expected a book” “I am shocked by the presentation and information”…….”I expected a diet plan”!!!

I    Is Ashy Bines being bullied?

1    We focus on using information which we research and then obtain evidence to educate women and former and potential customers about ABBBC Pty Ltd and the Brand Ashy Bines, not Ashy Bines personally so  please make that distinction.

1    We do not remove comments in the sense that people are (as per our disclaimer) responsible for their own comments) however our Mission Statement makes it clear what our objectives are and what we are trying to achieve. We will however remove hateful comments which are a breach of TOC’s of facebook if we see them.      We believe that ABBBC and the Brand Ashy Bines lacks ethics and integrity when engaging in the conduct of its business. We are not saying that there are not success stories nor that the bootcamps are not successful and well run, our focus is the points previously outlined. Hence we do not believe we are engaging in conduct which is categorised as bullying when we use facts and investigate issues and post information to rebut what has been said and or stated by third parties associated with ABBBC and the brand Ashy Bines.

The page has evolved from its creation to a factually researched information / whistle blower activist community.

1     We object to the exploitation of women’s transformations for the purpose on-selling more product/service when some of those women’s photos are subject to abuse and are vulnerable to viral uploading without the person being properly versed or vetted nor explained how their transformation could lead to hurtful hate comments and then be exploited to being downloaded from the fanpage and end up all over the world. How Ashy Bines Supporters treat us – Latest Example

The admins and other members of the advocacy page are constantly under attack with the most hateful and disgraceful comments, or with comments which are made, then allegations that the opposite has occurred on another page in order to try and discredit members of the admin team. We work very hard to give everyone a voice and we do not want to publish most of the horrible and cruel posts which have been posted but in this latest example (which is not as emotive nor particularly offensive), we were the subject of falsehoods and vitriol, and once the person was caught being dishonest, not only did he report the posts which demonstrated his lack of integrity but he removed his own post and alleged he was blocked when that was absolutely incorrect.

To be fair, his partner was blocked, a number of people reported her post, it spammed and blocked, and as soon as I realised she had been blocked she was immediately unblocked so she was given a right of reply.We try not censure people’s right to express their opinion as long as it is respectful.

I will not name this poster because unlike many people, this young woman was a real victim of cyberbullying and suffered a great deal at the hands of a vexatious and obsessed woman so her identity will be protected. I believe her passion in defending Ashy Bines, stems from her own experiences of being a victim, and as tragic as it is, she has never really taken the time to really look at how the page conducts itself, which has since August, worked hard to promote evidence based information.

A valid point there are a lot of dangerous products in the market place, but this page is a consumer advocacy page for ABBBC customer service issues, and clearly neither him nor the person who he calls his partner read the actual links which explains what we were saying about Oxy and Jack3rd including that ABBBC or Ashy Bines would not be advocating for the sale of this product on their closed facebook forum given Ashy Bines ‘the brand’ and personal views on duromine. It is a clean eating forum, and until the ingredients of these substances are changed, ABBBC could be held vicariously liable for the sale on their company forum in the event that the posts continue to be unmonitored.

Yet these products continue to be sold and further should a customer become ill or have severe side effects, the liability falls not only on the seller but because its in the context of the ABBBC forum, then it poses some ethical and potential civil liability litigation risks given that ABBBC have  employed moderators to monitor the facebook forum.

After reporting Cathy Brophy’s account to facebook when he was caught lying about how the page respected his post and left it untainted without removing nor banning him, his report attempts to hide the evidence and the fact that he has made a public post which is demonstrated as misleading and ill conceived.

There were no breaches of Facebook Terms and Conditions, Brad was caught in a lie, removed his own post, cheekily came back at 9.36pm to like a post after he reported the posts which demonstrated his lack of credibility and integrity.

We are using this as an example of what we have to put up with every day. We respected Brad’s point of view and debated the issue with him. We do not ban people without a warning or unless the behaviour is outrageous it crosses all boundaries of acceptable societal norms.

For the record, we are not lazy, hateful, overweight, fatties who hate or hate on others. We are an educated team who spend the time doing research and try our best to provide feedback and information to our members. We listen to what they have to say, and we accept constructive criticism. We may not agree but we have at times conceded when we have made an error of judgement and we take responsibility for it.

We do not get paid, we do not ask for recognition we are activists for a collective of women who need assistance with a program whereby they feel as though they did not get what they paid for and the conduct and or business practices of ABBBC leave some questionable issues which have been canvassed.

Whilst we took the time to blog about the dangers of banned substances it seemed to make no difference to the moderators on the facebook forum, as after our blogs were written the following posts were made by desperate women seeking banned substances to increase weight loss fast!

Accordingly despite the fact that we wrote the blogs, that it is against the rules of the forum, there are still posts selling illegal drugs! Some members are sensible but these posts do not comply with ABBBC  rules of their forum so why is it unmoderated? ASHLEY HALL: The Therapeutic Goods Administration has banned a sports supplement ingredient popular with bodybuilders, citing concerns it could have lethal side effects.

The chemical, known as DMAA, provides an adrenaline-like high for athletes, but it’s been linked to side-effects including vomiting, stroke, and even death.

Dr John Skerritt is the national manager of the Therapeutic Goods Administration. He spoke to our reporter Liz Hobday.

LIZ HOBDAY: Why do people use these supplements?

JOHN SKERRITT: They’re generally combined into so-called sports food especially for body-builders to bulk themselves up, to increase their muscle mass. The substance itself increases their heart rate and gives them a bit of a high after they use it and while it is not addictive the problems that it causes by increasing the heart rate has led to a number of emergency room presentations and suspected deaths.

LIZ HOBDAY: Is it widely used as an ingredient? I understand it is also used by people in the mining and trucking industries to keep them awake.

JOHN SKERRITT: It is not very effective at keeping people awake but there is some concern that it is used in its pure form, you know, taken in capsules as well as within body-building products and I understand later today the West Australian coroner will release the decision about the death of a fly-in fly-out worker who may have been taking one of these substances.

LIZ HOBDAY: How dangerous is it?

JOHN SKERRITT: If taken in very high levels it can be quite dangerous and one of the challenges is that clearly people buy large containers of these sports food products and especially in New Zealand, in parties people have been consuming literally soup bowls full of it like a porridge.

And in the US there has been a couple of cases of US Army staff who died through heart attack after exercising and consuming a large amount of these products.

LIZ HOBDAY: So it is still on the shelves in Australia now?

JOHN SKERRITT: Until August the 8th. We published the decision this morning and the way it works is the implementation date is one week later, Wednesday the 8th of August. Then it is for the states and territories to have to actually formally implement the ban.

LIZ HOBDAY: I’ve seen web postings today from companies selling supplements with DMAA online and they are urging people to buy as much as possible before the ban is enforced. What do you think of that?

JOHN SKERRITT: It clearly is not good advice and once the implementation date on the 8th of August happens it will actually be prohibited and once the states enforce it, prohibited to sale, supply and use these substances. But my personal view would be that I wouldn’t be recommending people to take these substances.

LIZ HOBDAY: If people have these supplements at home, how do they know whether they contain this chemical and what should they do?

JOHN SKERRITT: There is a range of product names that were put out by our colleagues in the Foods Standards Australia New Zealand agency. They actually described a range of brands that tested positive for DMAA and they have some pretty quaint names – Nox Pump, 3D Explosion, Beta-Cret, PreSurge, 1 MR, Cryoshock, Jack 3D, Mesomorph, Neurocore, Oxyelite and Hemo Range Black but if people go to Food Standards website they’ll actually see a list of the products that have been tested and shown to contain DMAA.

LIZ HOBDAY: Do you think Australia was slow to move on this given that the ban came months after other countries banned it including the US and New Zealand?

JOHN SKERRITT: We had a process in place early in the year to consider this and for every potential banning of a substance there is a committee that reviews them. That takes evidence both from people for example in the medical fraternity who are concerned about the effects of the substance and they also take into account evidence from industry including the body-building industry, some of whom submitted statements in support of continuing open availability.

So we have to follow through due process but having started to make the decision early in the year it is now mid-year and a decision has been made. It is important that there is appropriate process where people can argue both sides.

Banned: Jack3d contains a stimulant called DMAA

A sports supplement popular with fitness fanatics has been banned in Britain because of fears it may have lethal side-effects.

The drink Jack3D contains a stimulant known as DMAA (dimethylamylamine) that has been linked to high blood pressure, headaches, vomiting, stroke and even a death.

The UK’s medicines watchdog MHRA (Medicines and Healthcare products Regulatory Agency) has ruled it is unlicensed and all other DMAA containing products need to be removed from the market to protect public safety.

The decision follows similar warnings around the world, including in the US and Australia where a man died after buying DMAA online. 

Jack3d is said to boost energy, concentration and metabolism. But DMAA, most commonly used as a workout aid or dietary supplement, can have a physiological effect on the body by narrowing the arteries and raising the heart rate, said the MHRA.

This has been linked to suspected adverse drug reactions worldwide, ranging from shortness of breath to heart attacks.

An MHRA spokesperson said: ‘Jack3d is mainly bought over the internet although it is also available in sports stores specialising in work out products.

‘If we find a shop selling it we will send them a written reminder asking them to remove it from their shelves. If they ignore this then our enforcement officers will move in and begin legal action.

‘It is the most popular sports supplement in the UK because it is a stimulant that allows you to work out for longer.

‘But it is for people who are really into their fitness. Your average person who goes to the gym once or twice a week is unlikely to have ever used it.’

The MHRA has already issued eight urgent notices instructing retailers to remove the product and any other DMAA containing products from sale.

The MHRA has recently taken action against a number of products presented as sports supplements that fall within the definition of a medicinal product because of the potent herbal ingredients they contained.

The chemical ingredient DMAA is also on the prohibited list of banned substances by the World Anti-Doping Agency and has been responsible for 137 doping violations worldwide.

A HOST of popular sports supplements will be banned and listed alongside hard drugs if the Therapeutic Goods Administration acts on advice from federal health authorities.

The Department of Health has proposed classifying DMAA – dimethylamylamine, a stimulant found in many pre-workout products – as a schedule 9 drug, putting it in a similar category to drugs such as heroin, cocaine and crystal methamphetamine.

If the change is approved, DMAA, found in many over-the-counter supplements, would become illegal to manufacture, possess, sell or use.

The stimulant – already banned in Canada, New Zealand and several European countries – has been linked to two possible deaths in the US and is thought to cause cardiovascular problems including high blood pressure, shortness of breath and possible heart attack.

Health experts contacted by The Sunday Age agreed that if it was taken in excess, the stimulant could put the body under strain, but they cautioned that there was little research available into the drug.

An advisory committee of medical, pharmacy and health industry experts has made recommendations on the department’s proposal and the decision on whether to ban DMAA now rests with the TGA.

Products containing the stimulant, which include the high-selling Jack3d, are used by bodybuilders, as well as students and miners to combat fatigue. The supplements are usually bought as powder, which is then mixed with water and drunk to heighten energy and alertness.

The threat of a ban has prompted users to stockpile workout supplements containing the stimulant, according to Scott Goble, the reigning International Federation of Bodybuilding’s Super Heavyweight Mr Australia champion.

Mr Goble, who works at Doherty’s Gym in Brunswick, said most bodybuilders he knew took DMAA and that news of an imminent ban had led many to start buying it in bulk.

”There was a bit of hysteria and some of the supplement companies were promoting the fact that it was going to be banned at the end of August, so I know a lot of people went out and bought 10 tubs just to stock up,” he said.

Mr Goble has been taking DMAA for about a year, and uses Cyborg Sport’s Bionic brand about four times a week before workouts.

The 36-year-old said that while bodybuilding organisations banned the substance for use on competition day, contestants were permitted to take it in the run-up to events.

”I use it if I’m tired or feeling a little bit flat,” he said, adding he was not concerned about the potential health risks associated with the drug.

”Over 1 billion doses of this supplement have been taken and they’ve only had 40 suspected reactions, so I’m pretty happy playing those odds.”

A senior sports dietitian at the Australian Institute of Sport, Greg Shaw, said there were potential risks if the product was misused. But he said the little information that was available about the effects of DMAA mostly came from emergency room reports, where people had presented with cardiovascular problems.

The Department of Health declined to provide details about why the substance is considered so dangerous it should receive a schedule 9 listing, because the proposal is still under consideration.

The chair of toxicology at the Australasian Society for Pharmacology and Toxicology, Dr Ian Musgrave, said he was ”baffled” as to why DMAA was being considered for such a serious ban. ”Even amphetamine is schedule 8,” he said. ”Unless the department has information I haven’t seen, it’s unclear why they want to make it a schedule 9 drug.”

Dr Musgrave said DMAA appeared more suited to be classified as schedule 4, which would put it on a level with drugs such as pseudoephedrine, which is found in many medications.

Last month, however, Food Standards Australia New Zealand issued a consumer warning against DMAA, citing complaints from consumers and adverse health reports.

The US Food and Drug Administration issued warning letters to manufacturers and distributors in April, noting DMAA is ”known to narrow the blood vessels and arteries, which … may lead to cardiovascular events”.

The alert came after DMAA was linked to the deaths of two US soldiers who had heart attacks following training. Both had DMAA in their blood.

That same month, the Australian Department of Health called for public submissions on a proposed ban. The submissions were referred to an advisory committee, which met last month. The TGA will publish an interim decision on its website in coming weeks.

What’s the problem with OxyElite Pro?

For better or worse, being thin and fit has long been an obsession in American culture. For most people, though, losing weight is an excruciatingly slow and difficult process. • Cirsium Oligophyllum
• Rauwolscine
• 1,3-Dimethylamylamine (DMAA)

DMAA is the main active ingredient contained in OxyElite Pro, and is designed to give the user increased workout intensity, focus, and other desired effects associated with elevated adrenaline levels. However, DMAA has recently come under scrutiny by the U.S. Food & Drug Administration (FDA) due to its potential for serious side effects and life-threatening complications.

First synthesized and patented by Eli Lilly in 1944, the pharmaceutical giant went on to trademark the compound as a nasal decongestant known as Forthane in 1971.

According to one Chinese study published in the Journal of Guizhou Institute of Technology (1996, Vol. 25, pp. 82-85), DMAA is derived from geranium oil, but no other research to date has been able to detect its presence. The American Herbal Products Association (AHPA) enacted a trade requirement that went into effect in January 2012 which bars its members from labeling DMAA as a geranium-based constituent.

Due to the fact that DMAA is currently classified as a food additive, it does not require approval by the FDA to be sold on the U.S. market. However, a number of highly-respected sports organizations such as Major League Baseball and the World Anti-Doping Authority have reclassified DMAA as a banned stimulant.

The most serious side effects reported in OxyElite Pro users include:

Deaths Linked to OxyElite Pro

In February 2012, the United States Department of Defense (DoD) banned sales on dietary supplements containing DMAA in military facilities following the sudden deaths of two soldiers. In the summer of 2011, a 22-year-old soldier collapsed and died while running at a Southwestern US military base. No more than three months later, a 32-year-old soldier collapsed while exercising and subsequently died after a month of intensive care in the hospital. Both soldiers were later found to have DMAA in their systems at the time of their deaths.

In response to these tragic events, the surgeons general of the military services have been ordered to conduct a thorough investigation regarding the safety and efficacy of DMAA. The DoD’s ban on the substance will remain in effect pending the results of the investigation. Yet despite the military moratorium on DMA-containing dietary supplements, products like OxyElite Pro and Jack3d remain on the shelves of nationwide retailers like GNC and The Vitamin Shoppe.

OxyElite Pro is a dietary supplement sold as a “super thermogenic fat burner” to fitness enthusiasts looking for performance enhancement during their workout. It containsDMAA, which is a stimulant chemical with stimulant properties similar to ephedrine and amphetamines. UPDATE: FDA Sends Warning Letter to Manufacturer of OxyElite Pro

April 27, 2012 –USP Labs, LLC, the company that manufactures and distributes OxyElite Pro, has just received a Warning Letter from the U.S. Food and Drug Administration (FDA). The FDA has concluded that “synthetically-produced DMAA is not a ‘dietary ingredient’ and, therefore, is not eligible to be used as an active ingredient in a dietary supplement.” The company is being specifically cited for failing to provide the FDA with a New Dietary Ingredient (NDI) notification. By law, all supplements that contain ingredients introduced after 1994 must provide the FDA with an NDI with evidence of the safety of the ingredient. Because manufacturers have never provided the FDA with this information, supplements containing DMAA are adulterated. Furthermore, the FDA warns that DMAA is known to cause blood vessel constriction, which can elevate blood pressure and increase the risk of deadly heart attacks.

Military Bans DMAA & OxyElite Pro after Soldier Deaths

The U.S. Department of Defense banned the sale of DMAA on military bases after two soldiers suffered fatal heart attacks on the same base in the American Southwest. One soldier who died was a 22 year-old, who collapsed during a training run. The other soldier was a 32 year-old, who collapsed during a physical fitness test. Both soldiers had DMAA in their bloodstream.

The military decided to pull DMAA products (including OxyElite Pro) off the shelves on military bases pending further review of the safety of the products. They cited concern that the products could cause deadly cardiovascular events, higher blood pressure, liver and kidney failure, lethal exhaustion, and more.

Another death linked to DMAA was a New Zealand man who took DMAA-laced party pills and later died. Though his death may have been caused by factors other than DMAA, the fact that he had DMAA in his bloodstream is a cause for concern. Following this death, the government of New Zealand banned the sale and use of DMAA.

OxyElite Pro and the Geranium Plant

On the ingredient label for OxyElite Pro, DMAA is listed a “geranium stem.” A spokeswoman for USPlabs told the New York Times that DMAA is a natural substance derived from an Asian geranium, no more dangerous than caffeine, and has been used as food for more than a century.

The link between DMAA and the geranium plant is a point of contention, with most experts now agreeing that there is no credible evidence linking DMAA to any natural source. The government of Canada and New Zealand have banned DMAA because they believe is a synthetic drug. The American Herbal Products Association (AHPA), an herbal supplement trade group, has also banned its members from advertising DMAA as any part of the geranium plant.

The only report linking DMAA to the geranium was published in a Chinese technical journal in 1996. The report was not peer-reviewed. The authors of the report took dried botanical samples from a species of Asian geranium, and then ran the samples through a gas-spectrometer machine. The analysis included an automated system that identified 40 different compounds in the plant, including DMAA. Since that report was published, no one has been able to reproduce the results. The manufacturers of DMAA have never provided an independent chemist with the cut and dried botanical samples from which they purportedly derive the drug.

Though the evidence linking DMAA to a natural source is very weak, the evidence linking DMAA to a synthetic source is relatively strong. Synthetic DMAA was first mass-produced by the pharmaceutical drug company Eli Lilly in the 1940s. The company developed the drug as a nasal decongestant spray called Forthane, which was not a success. In the 1950s, safety studies of DMAA in animals found that it was more potent than ephedrine. Ephedrine was once a popular dietary supplement in the U.S., but it has since been linked to life-threatening cardiovascular events.

The Therapeutic Goods Administration (TGA) is aware that some Australian consumers may have purchased the product OxyELITE Pro capsules over the internet or in retail stores. This product is marketed as having super thermogenic (weightloss) properties.

Analysis undertaken by the TGA Laboratories in Australia has confirmed the presence of therapeutic quantities of Yohimbine in these capsules. Consumers are advised that Yohimbine is a prescription-only substance in Australia; however it is not approved for supply in any registered medicine within Australia. Yohimbine is also a prohibited import under Customs legislation without appropriate permits. Yohimbine can pose serious health risks for people with underlying risk factors.

OxyELITE Pro capsules have not been assessed by the TGA for quality, safety or efficacy as required under Australian legislation, and the place of manufacture is not approved by the TGA. In Australia, supply of OxyELITE Pro capsules is illegal.

If you have purchased OxyELITE Pro capsules you are advised to cease using them and discard any remaining product. If you have concerns arising from your use of this product, you should consult your health care practitioner.

We are committed to ensure that if ABBBC or Ashy Bines wants to provide advice, the advice is provided by a qualified member of staff, this sort of advice is negligent and could lead to ABBBC being sued in personal injury (Torts Law)- for failure to provide advice when you ought to have known that advice was inappropriate or you were not qualified to provide it.

Why have an APD dietitian employed to answer questions on the forum if you are not going to refer clients that have special needs/requirements such as pregnancy to her?

Your plan is certainly NOT ok for pregnancy!  I wonder if one day when you yourself are pregnant that you will be so ‘flippant’ with your diet.  You really show your  inexperience more than ever with this response and highlight EXACTLY why you need to be reprimanded for your behaviour.  Time for you to look up the words  ‘due diligence’, which you can ‘Google’ it if you aren’t sure what it means.

Due diligence is exactly why we at Diet Chat, qualified APD dietitians, have replied to this post.  We are shocked that you would promote a ‘bikini model diet plan’ to someone who is pregnant!  Your diet plan may help women shed kilos fast but it isn’t sustainable for long periods of time let alone for during pregnancy.  You should have referred her to someone qualified who would have advised the following.

It is very important during the pregnancy to maintain healthy weight gain and not to diet or skip meals. Not gaining sufficient weight can increase the risk of preterm birth however gaining too much weight during pregnancy can increase your risk of high blood pressure, gestational diabetes, birth defects and difficulty losing weight after the birth of your baby.

During pregnancy it is quite normal to gain between 12-14kg. Your weight gain will depend on your weight and BMI (Body Mass Index) before you became pregnant.  As a general rule the below table can provide you with a guide of how much weight you should gain:

BMI prior to falling pregnant      Expected weight gain

Less than 18.5kg/m²                       12.5 to 18kg

18.5 to 24.9 kg/m²                          11.5 to 16kg

25 to 29.9 kg/m²                             7 to 11.5kg

Above 30 kg/m²                              5 to 9kg

To address each point individually the client has asked you what the best things are to eat for pregnant people, your reply is “everything on the plan is fine hun”.In our qualified opinion, your plan is certainly not suitable during pregnancy.  The plan discourages dairy, fruit and carbs and worst of all promotes calorie restriction which is certainly not recommended during pregnancy.  Calorie restriction during pregnancy can lead to increased risks of developing coronary artery disease and diabetes later in life along with a negative effect on physical, developmental, mental and cognitive development.  Not to mention it can cause the development of a genetic link to the ‘thrifty gene’ predisposing the child to obesity later on in life.   In your plan you also recommend a variety of protein powders and supplements that contain ‘secret ingredients’ that do not legally have to be disclosed on the label.  These additives have not been tested so we certainly would not recommend these during pregnancy.  The only supplement we recommend during pregnancy is a Pregnancy Multivitamin such as Elevit and more specific vitamins/minerals such as iron/folate if needed.

A pregnant woman must try to get foods from each of the food groups on a daily basis.  We recommend the following:

Meat, fish, poultry, eggs, nuts, legumes	1 ½	·         65 – 100g cooked meat/chicken ·         80 – 120g cooked fish ·         2 small eggs ·         1/3 cup peanuts/almonds
Extras	0-2	·         3 to 4 sweet biscuits ·         30g potato chips ·         2 scoops ice-cream

Your next recommendation is to “try to cut carbs out at the end of the day” when in actual fact there is an increased requirement for energy and carbs especially during the 2^nd and 3^rdtrimesters.  Our recommendations are:

Energy requirements (kj/calories)

First trimester:   No additional energy required

Select nutrient dense food sources;

–              Whole-grain bread and cereals

–              Legumes

–              Dark green vegetables

–              Citrus fruits

–              Milk products

–              Meats, fish, poultry and eggs

Second Trimester:    Additional 1430kj (340 calories) per day (on top of non-pregnant  female energy requirements)

Third Trimester :   Additional 1900kj (450 calories) per day (on top of non – pregnant female energy requirements)

Carbohydrate requirements

Carbohydrates are essential to providing sufficient energy and it is generally recommended between 135g to 175g or more per day but rather than focusing on the total amount each day we prefer to recommend pregnant women include carbs with every meal and snack – 15-30g.  It is best to select fibre containing carbohydrate foods such as whole grains and fruit/vegetables and these should not be avoided or decreased during pregnancy.

You then recommended 3L water daily but for most this is actually too much water and can lead to a condition called “hyponatremia” (low sodium levels caused by too much fluid diluting these levels).  As consulting dietitians to a private hospital we see many people admitted to hospital with this condition which is basically a result of ‘eating too little’ and ‘drinking too much water’.  So you can have too much of a good thing! We see many inexperienced weight loss gurus recommending 3-4L of water along with an extremely low calorie diet without realising just how dangerous and life threatening this can actually be, particularly if you are pregnant.  Current recommendations for pregnancy are 1.5-2L daily.

In summary, this table clearly shows the recommendations for non-pregnant, pregnant and lactating women and your plan is not suitable for either pregnancy or lactation and doesn’t meet some requirements for non-pregnant women either!

Your blasé response to this question is disgraceful and you really should be held accountable for your recommendations and actions as you are putting this woman’s own health and the health of her baby at risk and I would hate to think of how many other customers  you have provided such vague and inexperienced advice to.

Your baby will learn to survive off of less energy/nutrition and this can continue on after birth causing ongoing weight and health issues for the child in the future!

When you are pregnant, your baby also needs calcium not only for building strong bones and teeth, but also a strong heart, nervous system and muscles. If calcium is inadequate then the baby will draw as much as it can from its mums bones but this deprivation can lead to problems later on in life for both mum and baby.

Inadequate intake of wholegrains, fruit and food variety in general also leads to poor health for mum and bub, not to mention the lack of fibre which can lead to constipation.

In your plan you also recommend a variety of protein powders and supplements and even though the woman has stated she is ’16 weeks pregnant’ you proceed to ask her if she is breast feeding?

THE NOAMI CRUZ – TESTIMONIAL – ABBBC CAUGHT IN MISLEADING & DECEPTIVE CONDUCT AGAIN!!!!

What an extraordinary day it was on the Ashy Bines Bikini Body Challenge Fan Page, first a new status was put up with a compelling transformation, or was it?

Noami Cruz is a US citizen who is not a customer of ABBBC nor was she, all the searches have been undertaken on their online forum and their facebook forum.  All of a sudden we looked again at the transformation and thought, the timeline is off, the transformation is amazing but is she really an Ashy Bines’ customer?

In search of the information the photo was downloaded and a reverse search done via the google search engine. This means you reload the photograph thru google and see what comes back up! This is a process we often use with Ashy Bines transformations as twice before we found another US testimonial had been stolen and uploaded to their page, and another testimonial belonging to an Ashy Bines’ loyal clean eater was found to have been used (with different blurb) on one of Steven Evans’ websites forcing Steve Evans to issue an apology to the poor woman who found the information because it was seen by others on the Ashy Bines Bikini Body Challenge Waste of  $ facebook page.

The candidate is Annette Cruz from NYC aged 35.

So this is what happened next, people wrote hundreds of comments, as it truly is a credit to this woman, she has done an amazing job!

People were sceptical so would I be, from 18 June to 1 September is a lot of weight to lose when Annette admits to doing very little exercise but walking. (see the links to tumblr accounts).

Then, once people started to post information on the Ashy Bines page, the game was up and of course Admin were forced to remove the post! Pronto, they were after all caught red handed.

This was the testimonial put to Annette’s name however for this  testimonial they changed her name to Naomi? Go figure? Her name is not Noami at all but Annette 🙂

ABBBC – you are lying to your fans, again! – AT NO TIME DID ANNETTE OR NAOMI CONTACT OR COMMENT ON THE PAGE. You have no credibility even with the people who are your fans.

The Waste of Money page has contacted this particular girl so do not be silly and open a fake profile,  she has been located and that response is to be published in due course. Know this, you were caught out this time, the second time with a stolen picture from the USA.

This woman’s weight loss journey is particularised in the the tumbler blog – and that is where you stole it? Why because people are questioning you now, they are using the GOOGLE search engine.

As Judge Judy would say “if it does not look right nor sound right then ITS NOT TRUE”…….

What is the matter running out of real customers who will share their pictures with you, you have been spamming the fan page so much lately with sponsored advertisements to generate more SALES………people are not stupid, that is why the Customer Complaints page has more than 11,000+++ unhappy customers!

ASHY BINES EXPOSED ON AUSTRALIAN NATIONAL TV – ACA BIKINI DIET RIP OFF

Ashy Bines Bikini Body Challenge which  advertised on a fan page on facebook and you-tube driving most of us here on the Gold Coast Australia crazy on most of us in facebook land to despair with never ending sponsored adverts.

Ashy Bines, what does she offer? A cheaply put together pdf of 48 page (updated) with a cookbook which is all plagiarised on from the internet and fellow forum members. She omits to tell her cult followers that you need to spend a lot of time in the gym to get that perfect bikini body!

Her facebook page purchases (I did not know you could do this either but you can) likes so her page is popular but not like one would like us to believe.

ABBC’s popularity has been obtained  misleading and deceptive means, poor customer service, a complete disregard for the women who are vulnerable to her ‘you can lose weight fast guaranteed’ which is a complete nonsense.

Great marketing? Perhaps,  but in truth it invites women to believe the whole fantasy that her ABBBC page on facebook is built on reputation and popularity. Now what is the purpose of this blog, to give you a chance to look at the information for yourself. If you want to buy it, then its your dime but at least you would have had a chance to peruse the information prior to choosing the path of Ashy Bines Bastardised ideal of what Clean Eating is, which is really not Clean Eating, per se! Especially  when you are told that you should be buying her new protein TONE which is repackaged cheap product full of artificial sweeteners.

Hypocrisy or money making enterprise? The facebook page Ashy Bines Bikini Body Challenge = Waste of Money has done all the research you need.  This blog will be updated regularly now to expose the lack of moderators in the facebook forum, the continued poor support, the furphy that a 24/7 concept of service exists!  Lest we omit to point out the questionable issues relating to some questionable transformations.
